GERMINATION LIMITED WARRANTY 

for 

Seed Pod Kits

Effective March 6, 2025


What Is Covered:

  • This limited warranty applies to all AeroGrow seed pod kits purchased from one of our authorized sellers in the United States on or after March 6, 2025 and replaces the warranty included in the seed pod kit manuals provided with the seed pod kits and the manuals available online.
  • This limited warranty covers defects in materials, workmanship, and germination of seeds for ninety (90) days from date of purchase (or date of delivery, for purchasers located in the State of California) from an authorized AeroGarden seller.
  • AeroGrow may replace a non-germinating seed pod with another seed pod of its choosing, or refund the money actually paid by the original retail purchaser of the product.

Limitation on Duration of Implied Warranties: 

  • There are no warranties which extend beyond those stated herein. EXCEPT AS STATED ABOVE IN THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES AND CONDITIONS THAT MAY BE APPLICABLE TO SEED POD KITS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, ARE LIMITED IN DURATION TO THE DURATION OF THIS EXPRESS WARRANTY. Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.


What Is Not Covered:

  • We cannot guarantee operability of seed pod kits used in growing units other than an official AeroGarden.
  • Because we cannot control the quality of products sold by unauthorized sellers, this limited warranty is not available for products purchased from unauthorized sellers, including unauthorized internet sites.
  • This limited warranty shall not apply to problems arising from: growing in a system other than an AeroGarden, unauthorized modifications or alterations of an AeroGarden or seed pod kit, germination of seeds not provided by AeroGrow, failure to adhere to Seed Kit Instructions and/or Quick Start Guide, improper use, maintenance or storage of Seed Kit, or use of materials not provided by or recommended by AeroGrow in or on the plants grown.
  • THIS LIMITED WARRANTY EXCLUDES ALL INCIDENTAL OR CONSEQUENTIAL DAMAGES. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
  • This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

Warranty Conditions:

  • This limited warranty is contingent upon: (a) the original retail purchaser contacting AeroGrow customer service after 3 weeks of planting the seed kit for replacement of a non-germinating pod, (b) the original retail purchaser submitting its original, unaltered purchase receipt to AeroGrow and (c) the original retail purchaser complying with AeroGrow’s return shipping instructions. Depending on the issue, specific product photos may be required.
  • You may notify AeroGrow by (x) submitting notice via the product support page at www.aerogarden.com/contact-us, or (y) writing AeroGrow International, Inc., c/o The Scotts Company LLC, 14111 Scottslawn Road, Marysville, Ohio 43040, Attn: Consumer Services.
